What is AI art?

AI art refers to artwork that is created with the help of artificial intelligence algorithms. These algorithms can be used to generate artworks, assist in the creative process, or be the main medium of the artwork. It is done through Machine Learning (ML) and Deep Learning known as neural networks which adapt and learn to information on huge databases to create unique digital images.

Will AI art replace Artists?

It is unlikely that AI art will completely replace human artists. While AI can automate certain aspects of the art-making process and generate new forms of art, it lacks the emotional intelligence, intuition, and personal perspective that human artists bring to their work. Additionally, AI art still requires human input and oversight in the form of programming, training, and curation.

 

It is more likely that AI art will augment the role of human artists, rather than replace them. AI can also be used to generate new ideas and inspiration for human artists to build upon. Ultimately, people will always want something created from the human hand.

AI art is created using a combination of algorithms, software, and data. The process typically begins with the artist or developer creating or selecting an algorithm or neural network, which is then trained on a large dataset. The algorithm or neural network is then used to generate art by analysing the dataset and creating new images or styles based on the patterns it finds. Every day it gets better. It is now the first open source AI that the public can easily use, to not only create art, but explore the near infinite use cases artificial intelligence has,

 

This process can be done using various techniques such as Generative Adversarial Networks (GANs), Neural Style Transfer, and Evolutionary algorithms. Additionally, some AI art may also incorporate interactive elements, where the artwork responds to user input or changes in real-time to create images.

There has been lots of justified outrage, due to artificial intelligence's neural learning using datasets of artist's work to generate images, and not giving compensation for doing so. Check out my articles on AI Art to dive deeper into this topics.

Can AI Art be Copyrighted?

Copyright law grants exclusive rights to the creators of original works of authorship. However, the question of who is considered the "author" of an AI-generated work is not entirely clear. Is it the person who created the algorithm or the AI itself?

 

In the United States, copyright laws protect original works of authorship. According to the U.S. Copyright Office, "a work is created when it is fixed in a tangible form of expression," and "the creator of the work is generally considered the author." This means that the person who writes the code for an AI-generated artwork is typically considered the author and would hold the copyright. However, this is not always a clear cut as the AI's algorithm might be considered as the author if it is autonomous enough.

 

Additionally, there is also a question of whether AI-generated works can be considered truly "original" and therefore eligible for copyright protection. Some argue that AI-generated works are not truly original because they are created by algorithms, rather than human creators.

 

As for now, the legal recognition of AI-generated art is still in a grey area and it would be best to consult a lawyer familiar with IP laws to have a better understanding of the copyright of AI art.
